Business Case Study; Risks of Franchise Litigation due to Disclosure Documents Updates

Most business executives know the importance of updating documents and investor prospectus. Failure to maintain records and can often lead to disputes at any time an investor loses money unexpectedly. In the franchise if a franchisee fails, files bankruptcy or is dismissed because most franchisors that this can also trigger disputes or legal issues, even if they are settled in arbitration.

In general, this franchise is an extremely long and there are always two sides to every story. Many of these cases are similar and franchisees know that they are often associated with arbitration and, therefore, will look for discrepancies, errors, or even request the disclosure of problems with documents given to the first hour of sales in May were the previous years.

As a retired Franchisor many dissatisfied franchisees will contact me to consult them on such things. Sometimes, these former franchisees seem to be upset at straws really seized? We have never once heard that they had any financial issues, so I can not imagine why they left and stole equipment, etc. Interestingly, the people are interesting, you think you know people and then one day disappeared.

But no matter, a franchisor must document, even footnote sections, which are not easy to understand in order to prevent future disputes. Of course, I am not a lawyer and it is not legal advice, plus a case study of the reality of the franchising industry and the need to update these UFOCs. Consider all this in 2006.
